Metro’s tuition break for undocumented students is unlawful, according to an opinion issued within the last hour by the Colorado Attorney General’s office.
“After carefully reviewing the state and federal law in this area, my office has concluded that Colorado’s state-supported higher-education institutions cannot create discounted tuition categories for students who are unable to prove their lawful presence in the United States,” Attorney General John Suthers said.
Metro’s Board of Trustees voted June 7 to approve reduced tuition for undocumented immigrants who graduated from Colorado high schools or earned their general equivalence diplomas in Colorado.
“Discounted tuition is a ‘public benefit,’ which under current state law may only be provided to individuals who prove their lawful presence in the United States,” said Suthers in his formal opinion.





And the school’s response is … ? Way to fail on the follow-through.
